No centro da discussão a necessidade de regulações que estabeleçam critérios a serem seguidos por empresas cujas filiais, terceiras contratadas ou fornecedoras adotam práticas de precarização do trabalho, baixos salários, desconsiderando principios humanitários fundamentais. Enfim uma regulação contra práticas abusivas que devem ser substituídas por princípio de responsabilidade da empresa em toda a sua cadeia produtiva.

O exemplo destacado é do colapso do Rana Plaza.

Empresas precisas ser forçadas a assumir um dever de vigilância sobre o que se passa na sua cadeia de produção.

The Rana Plaza tragedy demonstrated the need to regulate companies which use subsidiaries, subcontractors and suppliers to carry out underpaid work, without consideration for core humanitarian principles, including trade union and workers’ rights. Structures permitting companies to profit from such abusive practices should be replaced by a principle of company responsibility for their entire value chain.

A French law passed in 2017, which defines a ‘duty of vigilance’ for companies, provides important lessons for the drafting of an EU directive on due diligence. The duty of vigilance applies to human rights and fundamental freedoms, health and safety, and the environment. Going beyond a simple ‘due diligence’ obligation, it mandates companies to set up a ‘vigilance plan’ containing reasonable but adequate measures to identify risks and to prevent severe impacts on such rights.

A directive at the EU level on this issue should be adopted based on these principles. It should also contain appropriate internal monitoring arrangements (such as a ‘vigilance committee’ with stakeholder representation, including trade unions and worker representatives), proper external supervision (through a public supervisory agency) and adequate remedies, including criminal sanctions, disgorgement of profits, and punitive damages. The directive should apply to companies whose seat is in the EU as well as companies above a certain size threshold selling goods and services in the EU

Occupational safety and health in 2040: Four scenarios

This guide is the result of a project looking at the long-term prospects for making better and strategic decisions on occupational safety and health (OSH) in the European Union. The publication presents four potential scenarios (‘wellbeing’, ‘self-reliance’, ‘productivity’ and ‘protection’) for the future of OSH in the European Union.

The time horizon of the scenarios (up to 2040) focuses on the world in which the next generation will live and work, with the idea that inducing real changes requires a long-term perspective.

The scenarios presented in this publication aim at starting an open and constructive dialogue among the many stakeholders involved in workplace health and safety policies in the EU and its Member States.

Epigenetics and chemical risk management in the workplace

This guide provides a comprehensive introduction to epigenetics, the emerging science of biological mechanisms in the DNA which can change our genetic activity without changing the genetic code itself. The knowledge of epigenetics is important for workers as it could lead to retrospective proof of past exposure to (adverse) chemicals and early identification of dangerous chemicals at the workplace.

The authors try to answer several workplace-related questions such as:

    How fast will this emerging scientific field lead to the first practical results for workers? (E.g. in the form of biomarkers for work-related disease)
    To what extent are epigenetic effects reversible?
    Can epigenetic marks be transferred to children of workers (reprotoxicity)?
    Are there special groups of chemicals which are more likely to have adverse epigenetic effects than the average chemical? (e.g. Nanoparticles and Hormone disrupting chemicals like Bisphenol A).
    How should the ETUI and other societal actors play a role in using the emerging knowledge for the protection of workers?

In addition this report summarizes the outcome of a workshop that was organised by the ETUI and which brought together top scientists from the epigenetics field, EU Commission members, EU Parliament members (STOA), representatives from societal organisations and EU trade union participants.
